Terms of Service

Welcome to Bisket. These Terms of Service ("Terms") govern your access to and use of the Bisket platform, website, and services (collectively, the "Service") operated by Viral Hub Marketing LLC, doing business as Bisket ("Company," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Account Registration
To access certain features, you must create an account. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
3. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation
- Upload, transmit, or distribute any content that is defamatory, obscene, fraudulent, or infringes on the rights of others
- Attempt to gain unauthorized access to the Service, other accounts, or any related systems or networks
- Interfere with or disrupt the integrity or performance of the Service
- Reverse engineer, decompile, or disassemble any part of the Service
- Use automated means (bots, scrapers, etc.) to access the Service without our prior written consent
- Resell, sublicense, or redistribute the Service or any data obtained through it without authorization
- Misrepresent your identity or affiliation with any person or entity
4. User Content
You retain ownership of content you submit to the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, store, reproduce, modify, and display your User Content solely as necessary to operate and improve the Service.
You represent and warrant that you own or have the necessary rights to submit your User Content and that it does not violate any third party's rights, including intellectual property, privacy, or publicity rights.
5. Talent Data and Agency Responsibilities
If you manage talent profiles through the Service, you represent and warrant that you have obtained all necessary consents from the talent/creators whose data you upload, including consent for the collection, storage, processing, and public display of their information (such as on public media kits and proposals).
You are solely responsible for the accuracy of talent data you submit and for ensuring compliance with applicable data protection laws, including obtaining any required consents from talent for the use of their personal information and likeness.
6. Third-Party Services and Integrations
The Service integrates with third-party platforms and services, including but not limited to social media platforms (Instagram, TikTok, YouTube), cloud services (Google Drive, Google Sheets), data providers, and AI services. Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for the availability, accuracy, or content of any third-party service.
Social media data retrieved through the Service (including follower counts, engagement metrics, and public content) is sourced from publicly available information and third-party APIs. We do not guarantee the accuracy or timeliness of this data.
7. AI-Generated Content
The Service uses artificial intelligence (including services provided by Anthropic) to generate content such as campaign matching results, talent summaries, news briefings, and other analyses. AI-generated content is provided for informational purposes only and should not be relied upon as the sole basis for business decisions. We make no representations or warranties regarding the accuracy, completeness, or reliability of AI-generated content.
You acknowledge that AI-generated outputs may contain errors, biases, or inaccuracies, and you agree to review and verify such content before acting on it.
8. Intellectual Property
The Service and its original content, features, and functionality are owned by Viral Hub Marketing LLC and are protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written consent. Nothing in these Terms grants you any right to use our branding, logos, or other proprietary marks.
9. Payment and Subscription
Certain features of the Service may require a paid subscription. By subscribing, you agree to pay all applicable fees. Fees are non-refundable except as required by law or as otherwise stated in writing. We reserve the right to change pricing with reasonable notice. Failure to pay may result in suspension or termination of your account.
10. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may terminate your account at any time through the account settings. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including, without limitation, ownership provisions, warranty disclaimers, indemnification, and limitations of liability) will survive.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND COURSE OF DEALING. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL VIRAL HUB MARKETING LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify, defend, and hold harmless Viral Hub Marketing LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property, privacy, or publicity rights; (d) User Content you submit; or (e) talent data you manage through the Service without proper authorization.
14. Dispute Resolution and Arbitration
Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Commercial Arbitration Rules. The arbitration shall take place in the United States, and judgment on the arbitration award may be entered in any court having jurisdiction.
YOU AND VIRAL HUB MARKETING LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
16. Changes to These Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on the Service and updating the "Effective Date." Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.
17. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
18. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Viral Hub Marketing LLC regarding the Service and supersede all prior agreements.
